Ukrainian Declaration of Conformity

Declaration of conformity - a document issued by the first party (supplier, manufacturer or person authorized by him) certifying that the product (service) meets certain requirements. (Ukrainian Declaration)

Declaration of Conformity to Technical Regulations (Declaration of TR) – a document confirming that the product complies with the mandatory requirements of the Technical Regulations of Ukraine. The Declaration of Conformity (Ukrainian Declaration) is issued on the basis of evidence of product conformity and/or on the basis of control tests. Assessment of product conformity to the requirements of technical regulations is carried out in accordance with the Technical Regulations of Conformity Assessment Modules, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 95 dated 13.01.2016.

In total, according to this resolution, there are 16 conformity assessment modules in Ukraine. The choice of a conformity assessment module (Ukrainian Declaration) depends on the type of product for which the declaration is made, the product complexity class and its hazard category.

There are currently more than 40 Technical Regulations in force in Ukraine, and this list is constantly being updated. The list of products covered by mandatory technical regulations is constantly growing. (Ukrainian Declaration)

A declaration of conformity (Ukrainian Declaration) can be obtained for both a single imported batch of products and serial production.

List of documents required to complete a declaration for a batch of products (Ukrainian Declaration):

  • Supply contract;

  • Invoice;

  • Product description;

  • Test sample (or test report);

  • Technical specifications (diagrams, drawings);

  • Passports or safety sheets (if applicable);

  • Declarations and certificates from other countries (if available).

The list of required documents depends on the product for which a Ukrainian Declaration of Conformity (Ukrainian Declaration) must be issued and the requirements of a specific Technical Regulation.

The Ukrainian Declaration of Conformity (Ukrainian Declaration) for a batch of products is drawn up by the supplier of the products according to the shipping documents.

  • Product description;

  • Test sample (or test report);

  • Technical specifications (diagrams, drawings);

  • Passports or safety sheets (if applicable);

  • Test reports and certificates from other countries (if available);

  • Authorization from the manufacturer to carry out certification / conformity assessment work.

The declaration for serial production (Ukrainian Declaration) is drawn up in the name of the manufacturer or an authorized person on the basis of a power of attorney.

The declaration of conformity (Ukrainian Declaration) has the same legal force as the certificate of conformity. The Ukrainian Declaration of Conformity may be made for a specific product or a group of homogeneous products for which uniform requirements are established and subject to verification.

Conformity assessment modules in Ukraine (Ukrainian Declaration)

A declaration of conformity (Ukrainian Declaration) is a duly documented statement by the manufacturer, by which he guarantees the conformity of products with the requirements established by law, based on the results of conformity assessment procedures.

The scope of the required procedures is established by the conformity assessment modules (Ukrainian Declaration):

Module A – internal control of production (Ukrainian Declaration)
Module A1 – internal production control and controlled product testing
Module A2 – internal production control and controlled testing of products at random intervals
Module B – type checking
Module C – compliance with the type according to the results of internal control
Module C1 – compliance with the type according to the results of internal control and product testing
Module C2 – compliance with the type according to the results of internal control of production and product testing at random intervals
Module D – compliance with the type by ensuring the proper quality of production.
Module D1 – ensuring the proper quality of production
Module E – compliance with the type by ensuring the proper quality of products
Module E1 – ensuring the proper quality of production
Module F – compliance with the type based on the results of product testing
Module F1 – compliance with the type based on the results of product testing
Module G – conformity of a unit of production

Rules and conditions for applying the Ukrainian conformity mark (Ukrainian Declaration)

The mark of conformity shall be applied to the product or its data plate in such a way that it is visible, legible and indelible. (Ukrainian Declaration)

The right to use the Ukrainian conformity mark is granted to the applicant under a licensing agreement. (Ukrainian Declaration) If the applicant for certification is not the manufacturer of the products, but an authorised organisation acting on his behalf based on a power of attorney, the obligation to meet the marking requirements is imposed on the applicant.

The procedure for applying the national conformity mark for technical regulations is regulated by the Resolution of the Cabinet of Ministers of Ukraine of 30.12.2015 No. 1184. (Ukrainian Declaration)

The national conformity mark represents an unclosed base circle on the right side, with a stylised shamrock inside. (Ukrainian Declaration)

The conformity mark may be flat or embossed and must be in two contrasting colours. (Ukrainian Declaration)

The conformity mark shall be accompanied by the identification number of the designated conformity assessment body, if such a body has been involved in the production control stage, in the format UA.TR.YYY or YYY. (Ukrainian Declaration)

UA is the conventional designation of Ukraine in Latin letters; TR - the notation, which means that the conformity assessment body has been designated to carry out work on conformity assessment of the requirements of technical regulations; YYY - the identification number of the designated conformity assessment body.

The sign of conformity needs to be applied before the introduction of products into circulation. The conformity mark may be accompanied by a pictogram or any other sign indicating a particular risk or use. (Ukrainian Declaration)

The conformity mark is accompanied by the identification number of the designated conformity assessment body, if such body was involved at the production control stage (carried out conformity assessment work). (Ukrainian Declaration)

The height of the mark of conformity may not be less than 5 millimeters, unless otherwise provided by the relevant technical regulation. (Ukrainian Declaration)

Mandatory Document:

It is a mandatory document required for the customs clearance of products that fall under technical regulations, such as electrical equipment, children's toys, and personal protective equipment. 

How to Obtain a Ukrainian Declaration of Conformity

2. Gather Technical Documentation:

Compile comprehensive technical documentation, including test reports and safety assessments, to serve as evidence of compliance. 

3. Draw Up the Ukrainian Declaration of Conformity:

Create the declaration document according to the specific format and content requirements established by the relevant technical regulation. 

4. Apply the Mark:

Affix the national mark of conformity to the product as required by the applicable technical regulation. 

5. Register the Declaration:

Register the Declaration of Conformity with an accredited certification body, which will assign a unique registration number. 

The general conformity assessment procedure in Ukraine involves the following actions:

  • identifying the Technical Regulation(s) under which the product(s) fall(s);

  • determining the conformity assessment procedure for the products;

  • determine the other regulatory requirements for the product(s);

  • determine whether an independent conformity assessment of the product(s) is required by an approved conformity assessment body (hereafter "CAB");

  • testing and ensuring that the products meet the requirements of the Technical Regulation(s) and selected standards;

  • carrying out the conformity assessment by the CB;

  • drawing up a declaration of conformity;

  • marking of products, packaging, and accompanying documents.

The declaration is drawn up directly by the manufacturer without carrying out the conformity assessment work of the Certification Body only for module A. The application of the other modules implies the intervention of an approved CB, after which the manufacturer also draws up a declaration of conformity after the issue of the corresponding certificates.
